%X 随着数字经济的发展，合理使用要素分析逐步融入我国司法实践，但这一方法的适用也面临着诸多障碍。司法实践对“引用目的”和“市场效益”的理解存在分歧，各要素的权重、要素分析与我国现行规定的融合也需要进一步讨论。对此，应限定要素分析的适用范围，明确各要素内涵和关系，并坚持市场要素在合理使用判断中的核心地位。<br />
With the advancement of the digital economy, fair use factor analysis has gradually become integrated into Chinese judicial practice. However, the application of this method also encounters various obstacles. There are differences in judicial interpretation regarding the “market benefits” and “citation purpose”, as well as varying weights assigned to different factors. The integration of factor analysis with current regulations in China requires further discussion. In this regard, it is necessary to limit the scope of factor analysis application, clarify the connotation and relationship among various factors, and adhere to the central role of market factor in fair use judgment.
