%X 随着电子商务领域内的知识产权侵权现象的泛滥，及其导致的危害后果更加严重，相应的知识产权保护的市场需求也逐渐提高。而以电商平台为具体保护措施的实施主体是当下效益最高的保护方式。当下以“避风港原则”和“红旗规则”为核心建立的知识产权保护制度不足以满足知识产权保护的实践需求。原本使电商平台被动履行保护义务、减低责任承担的传统知识产权保护制度，应当向以督促电商平台主动履行保护义务、承担相应责任为导向的知识产权保护制度转变。应加大电商平台的保护责任，完善具体的实施标准，建构平台与权利人之间的合作机制。<br />
With the proliferation of intellectual property infringement in the field of e-commerce, and the resulting harmful consequences become more serious, the corresponding market demand for intellectual property protection is also gradually increasing. The implementation subject of specific protection measures based on e-commerce platform is the most effective protection mode at present. The current intellectual property protection system based on the “safe harbor principle” and the “red flag rule” is not enough to meet the practical needs of intellectual property protection. The traditional intellectual property protection system, which used to make e-commerce platforms perform protection obligations passively and reduce responsibility, should be transformed into an intellectual property protection system oriented by urging e-commerce platforms to actively perform protection obligations and bear corresponding responsibilities. We should increase the protection responsibility of the e-commerce platform, improve the specific implementation standards, and construct the cooperation mechanism between the platform and the obligee.
