%X ChatGPT是由OpenAI公司制作的新一代人工智能聊天机器人程序,自进入市场以来,为社会带来极大的机遇,但同时在法律层面也带来了极大争议。在主体上,ChatGPT不能成为适格“作者”;在内容上,ChatGPT生成物符合独创性要求,但是其不符合以人为本的创作理念,所以ChatGPT生成物不构成著作权法意义上的作品。且对ChatGPT生成物不予著作权保护,并不会影响投资者的创造积极性,并不予我国《著作权法》鼓励创作的目的相违背。从法理角度,将以ChatGPT为代表的人工智能,通过法律拟制为主体进行保护、ChatGPT生成物归属于设计者或者使用者,存在不合理之处。
ChatGPT is a new generation of artificial intelligence chatbot program produced by OpenAI company. Since its entry into the market, ChatGPT has brought great opportunities to society, but it has also brought great disputes in the legal level. On the subject, ChatGPT cannot be a qualified “author”; In terms of content, ChatGPT products meet the requirements of originality, but they do not meet the people-oriented creation concept, so ChatGPT products do not constitute a work in the sense of copyright law. In addition, the non-copyright protection of ChatGPT products will not affect the enthusiasm of investors to create, and will not be contrary to the purpose of encouraging creation in China’s Copyright Law. From the legal perspective, it is unreasonable to protect the artificial intelligence represented by ChatGPT through legal fiction, and the ChatGPT product belongs to the designer or the user.
