In the post-civil code era, the application framework of international treaties in China has been clearly stipulated and guided. As legal documents, international treaties are preferentially applied to domestic law and are binding. The legislature has clearly defined the conditions and principles of the application of international treaties in its legal documents, which provides a basis for the application of the courts in specific cases. In applying international treaties, the courts respect the choice of parties and take into account the application of international practice as a supplementary rule of law, so as to ensure the rationality and impartiality of the application of law.
