Copyright Protection Dilemma and Solutions for Artificial Intelligence News: A Case Study of the “Dreamwriter” %A 张颖凌 %J Open Journal of Legal Science %P 2705-2712 %@ 2329-7379 %D 2024 %I Hans Publishing %R 10.12677/ojls.2024.125383 %X 随着人工智能技术的飞速发展,其在新闻领域的广泛应用已成为瞩目焦点。同时,人工智能新闻的著作权是否存在,人工智能新闻的“作者”身份以及权责归属等问题也引发了较大的争议。本研究以国内首例人工智能新闻侵权案件——“Dreamwriter案”为研究对象,系统梳理了学术界与业界对此案的观点和争议,并在此基础上结合技术、法规和伦理三个维度,提出了人工智能新闻著作权保护的三条路径选择:一是发挥技术优势,加强作品质量与保护;二是完善相关法律法规,明确权责主体;三是强化传媒伦理观,提高生产者责任感,以期为解决人工智能新闻的著作权问题提供参考和指引。
With the rapid advancement of artificial intelligence (AI) technology, its widespread application in the field of journalism has become a focal point of attention. Simultaneously, significant controversy surrounds the existence of copyright for AI-generated news, as well as issues related to the attribution of authorship and the allocation of associated rights and responsibilities. This study focuses on the inaugural domestic case of infringement concerning AI-generated news, known as the “Dreamwriter” case, and systematically elucidates the viewpoints and controversies within both academia and industry. Building upon this foundation, the paper integrates insights from technology, regulations, and ethics to propose three pathways for safeguarding the copyright of AI- generated news: firstly, leveraging technological advantages to enhance the quality and protection of works; secondly, refining pertinent legal frameworks to delineate the entities responsible for rights and obligations; thirdly, reinforcing media ethics to augment the sense of accountability among producers. The aim is to furnish references and guidance for resolving the copyright issues surrounding AI-generated news. %K 人工智能新闻,著作权,Dreamwriter
