Contemporary Understanding and Interpretation of Marx’s “Class Nature of Law” %A 吴怡然 %J Advances in Philosophy %P 760-766 %@ 2169-2602 %D 2024 %I Hans Publishing %R 10.12677/acpp.2024.134113 %X 本文旨在重新审视马克思关于法的阶级性的论断,并探讨其在当代社会中的相关性与实践意义。通过对马克思主义法律理论核心概念的批判性分析和当代社会实践的案例研究,本研究解读了法的阶级性概念,并将其与当前法律现实中的阶级差异和利益冲突相对接。研究发现,马克思的理论在解释现代资本主义社会中法律现象时依然有着深远的分析价值,阶级性不但在法的制定中表现,也在法的执行和解释中得以体现。该研究的结论认为,法的阶级性不仅揭示了法律与权力结构的关联,而且为当前法律改革和社会公正提供了批判性的视角。
This article aims to revisit Marx’s assertion on the class nature of law and to examine its relevance and practical significance in contemporary society. Through a critical analysis of the core concepts of Marxist legal theory and case studies of contemporary social practice, this study interprets the concept of the class nature of law and connects it to the class distinctions and conflicting interests present in the current legal reality. The research finds that Marx’s theory retains profound analytical value in explaining legal phenomena in modern capitalist societies; class nature is not only manifested in the creation of law but also in its enforcement and interpretation. The conclusions of this study suggest that the class nature of law not only reveals the relationship between law and power structures but also offers a critical perspective for current legal reform and social justice. %K 马克思主义法律理论,法的阶级性,当代社会,法律现实,社会公正
