Regulation of Cyberviolence under Criminal Law

%X 网络暴力已经成为当今社会中的一种新型暴力形式,其所带来的后果也已逐渐超出民事、行政部门法治理能力的范围。但目前刑事领域针对网络暴力的规制较为滞后,学界对于是否能够利用传统罪名规制网络暴力行为存有争议。本文将网络暴力犯罪行为细分为侮辱、诽谤、寻衅滋事以及侵犯公民个人信息罪四部分,并通过分析每种网络暴力的行为的本质,结合网络暴力刑法规制的现状,分析现有规范的不足之处,并提出相应的完善路径,即在网络时代背景下对传统罪名进行符合时代语境的解释,细化量刑标准,对网络暴力行为进行充分的规制。
Cyberviolence has become a new form of violence in today’s society, and its consequences have gradually exceeded the legal governance capabilities of civil and administrative law. However, the current framework of criminal regulation of cyberviolence lags behind, and there is controversy in academia as to whether traditional crimes can be used to regulate cyberviolence. This article subdivides the crime of cyberviolence into four categories: criminal insult, slander, provocation and infringement of citizens’ personal information. By examining the nature of different types of cyberviolence behavior, along with the current situation of criminal law regulation of cyberviolence, this article analyzes the shortcomings of existing framework, and proposes corresponding improvement, that is, to interpret traditional crimes in the context of the Internet era, to refine relevant sentencing standards, and to fully regulate cyberviolence.
