%X 消费券发放是实现经济政策的工具,但是各地政府对于政府消费劵发放的程序、管理、平台选择等方面并没有进行专门立法,近些年公平竞争审查的构建和落实以及上升到法律,对于政府消费券发放政策有指导作用;政府消费券领域政策内容公平竞争审查的重点有对投放平台和参与活动商家的选择,因为在这两个方面的选择是最可能导致限制竞争的效果;但是对于在政府消费券政策进行公平竞争审查也不是就完全可以妥善运用,存在政府对公平竞争审查制度内涵和目标认识不明,自我审查能力不足,外部监督力量不够的问题;为了解决这些问题,要强化政府消费券政策的合法性和合理性审查,强化消费券政策审查的内部实质性审查和第三方评估,开放消费券使用参与机制,以保护市场公平竞争秩序和稳定发展。
The issuance of consumer vouchers is a tool to implement economic policies, but local governments have not enacted special legislation on the procedures, management, platform selection and other aspects of the issuance of government consumer vouchers. In recent years, the construction and implementation of fair competition review and its rise to the law have played a guiding role in the government’s policy of issuing consumer vouchers. The focus of the review of fair competition in the government’s consumer voucher policy is the choice of the platform and the participating merchants, because the choice in these two aspects is most likely to lead to the effect of restricting competition; however, the fair competition review in the government’s consumption voucher policy can not be properly used, there are some problems, such as the government’s unclear understanding of the connotation and objectives of the fair competition review system, insufficient self-review ability, and insufficient external supervision. In order to solve these problems, it is necessary to strengthen the review of the legitimacy and rationality of the government’s consumer voucher policy, strengthen the internal substantive review and third-party evaluation of the review of consumer voucher policy, and open the participation mechanism of the use of consumer vouchers, so as to protect the market fair competition order and stable development.
