%X 诚信原则在劳动合同纠纷司法裁判的解释运用中存在解释简单、解释模糊、解释欠缺等问题,产生的原因主要是法官的评判标准不一、劳动立法存在滞后情形以及诚信原则内涵丰富多元。诚信原则是劳动法领域政策制定的道德基础,为劳动合同纠纷司法裁判提供说理的依据,最终目标是促进法理和情理的有机融合。因此,在裁判过程中,法官需要履行忠实裁判义务,在准确援引诚信原则的基础之上,提升释法说理的能力,充分发挥社会主义核心价值观的价值引领作用。
There are some problems in the interpretation and application of the principle of good faith in the judicial judgment of labor contract disputes, such as simple explanation, vague explanation and lack of explanation. The main reasons are the different judging standards of judges, the lagging situation of labor legislation and the rich and diversified connotation of the principle of good faith. The principle of good faith is the moral foundation of the policy formulation in the field of labor law, and provides a reasonable basis for the judicial judgment of labor contract disputes. The ultimate goal is to promote the organic integration of jurisprudence and reason. Therefore, in the process of adjudication, judges need to fulfill the duty of faithful judgment, on the basis of accurately invoking the principle of good faith, improving the ability of interpretation and reasoning, and giving full play to the value leading role of socialist core values.
