%X 纵观中国历史上妇女再婚的情况,宋代妇女的再婚盛行现象无疑具有突出的特色。究其原因,在商品经济发达的宋代,人们的婚姻观和择偶观倾向于考虑更多的物质利益,同时社会风气的开放包容也降低了女性贞节观的影响力,尤其是宋代再婚法律的宽容为妇女的再婚自主权提供了坚实的保障,种种因素导致了宋代离婚妇女或寡妇再婚现象的普遍性。从法律层面可以看出,宋代妇女具有较高的法律地位,但在封建社会的影响下,宋代妇女的再婚自主权是有界限的。因此,要用历史的眼光辩证地看待宋代妇女再婚法律,在了解宋代妇女再婚的法律规制的基础上,深入剖析其背后的限制性因素,有利于合理地汲取宋代妇女再婚法律中体现的当代启示,进而为当代法律体系的完善提供有益的经验和教训。
Throughout Chinese history, the prevalence of remarriage among women in the Song Dynasty undoubtedly had prominent characteristics. The reason for this is that in the developed commodity economy of the Song Dynasty, people’s views on marriage and mate selection tended to consider more material interests. At the same time, the open and inclusive social atmosphere also reduced the influence of women’s views on chastity. In particular, the tolerance of remarriage laws in the Song Dynasty provided a solid guarantee for women’s autonomy in remarriage. Various factors led to the prevalence of remarriage among divorced women or widows in the Song Dynasty. From a legal perspective, it can be seen that women in the Song Dynasty had a high legal status, but under the influence of feudal society, the autonomy of women in remarriage in the Song Dynasty was limited. Therefore, it is necessary to dialectically view the remarriage laws of women in the Song Dynasty from a historical perspective. Based on understanding the legal regulations of women's remarriage in the Song Dynasty, it is necessary to deeply analyze the restrictive factors behind them, which is conducive to drawing on the contemporary inspiration reflected in the remarriage laws of women in the Song Dynasty in a reasonable manner, and providing useful experience and lessons for the improvement of the contemporary legal system.
