%X 时代发展推动人工智能不断发展,以马克思主义分析人工智能生成物的法律属性具有重要的意义。从主体资格看,人工智能不符合著作权法作者自然人要求;从客体资格看,人工智能生成物并不属于“智力成果”。ChatGPT生成物与人类作品的外在表现绘声绘色,催化了我国著作权法的发展。人工智能生成物的著作权保护存在侵权判定困难、生成物的保护存在争议、权利归属认定模糊、作品保护期适用不匹配的困境。对此笔者给出建立多方位监管、明确人工智能生成物的可著作权性标准、赋予使用者著作权归属、设置十年著作权保护期的优化路径。人工智能技术的发展势不可挡,要因时制宜的完善相关法律法规,以鼓励创新为宗旨,推动人工智能增进人类福祉。
The development of the times promotes the continuous development of artificial intelligence, so it is of great significance to analyze the legal attributes of artificial intelligence products with Marxism. From the point of view of subject qualification, artificial intelligence does not meet the requirements of the natural person of the author of the copyright law; From the point of view of object qualification, artificial intelligence products do not belong to “intellectual achievements”. The vivid ex-pression of ChatGPT products and human works catalyzes the development of copyright law in our country. The copyright protection of artificial intelligence products is difficult to determine infringement, there are disputes in the protection of products, the identification of rights ownership is vague, and the application of the protection period of works is not matched. In this regard, the author gives the optimization path of establishing multi-directional supervision, clarifying the copyright standard of artificial intelligence products, granting users the ownership of copyright, and setting a ten-year copyright protection period. The development of artificial intelligence technology is unstoppable, and relevant laws and regulations should be improved according to the time, so as to encourage innovation for the purpose of promoting artificial intelligence to improve human well-being.
