%X 《个人信息保护法》第47条规定了个人信息删除权,并明确了删除权的具体适用情形。但我国的删除权与欧盟的被遗忘权存在一定差异,这也导致在我国个人信息删除权的规范含义内,信息主体是否可以对搜索引擎运营者主张删除权存在较大争议。本文通过重新反思孙长宝校友录网站案中原告请求百度网站删除人脸信息照片的问题,从删除权的义务主体确认搜索引擎运营者的个人信息处理者身份,并以互联网时代下搜索引擎运营者负有的随从义务来探讨对搜索引擎运营者主张个人信息删除权的可能性。
Article 47 of the Personal Information Protection Law provides for the right to delete personal information and specifies the specific circumstances in which the right to delete applies. However, there are certain differences between the right to erasure in China and the right to be forgotten in the European Union, which has led to a major controversy as to whether the subject of information can claim the right to erasure against the search engine operator within the normative meaning of the right to erasure of personal information in China. By rethinking the plaintiff’s request for Baidu’s website to delete photos of facial information in the Case of Sun Changbao’s “Chinaren Alumni” Website, this article recognizes the identity of search engine operators as processors of personal information from the obligated subject of the right to erasure, and explores the possibility of claiming the right to erasure of personal information against search engine operators in terms of the accompanying obligation that search engine operators have in the Internet era.
