%X 算法和数据的发展为社会的发展带来诸多便利，但是在平台经济中，平台经营者往往滥用数据和算法，对消费者实施大数据杀熟行为，即同物不同价。这一行为侵犯了消费者的知情权、公平交易权等诸多权益，并且扰乱市场经济秩序的稳定和发展，因此需要对大数据杀熟进行规制。平台经营者和消费者是交易的双方主体，法律是社会治理的有效手段，政府是进行社会治理的重要主体，故应从法律、消费者、平台经营者以及政府监管四个方面分析大数据杀熟频发的原因。我国现有的法律规范体系尚不完备、消费者维权难度较大、平台对算法技术的滥用以及监管体系不完善导致大数据杀熟现象频发，故在此基础上提出健全法律规范体系、降低消费者维权难度、平台经营者加强行业自律以及构建完备的监管体系的规制路径。
The development of algorithms and data has brought a lot of convenience to the development of society, but in the platform economy, platform operators often abuse data and algorithms to carry out big data killing behavior on consumers, that is, different prices for the same thing. This behavior violates many rights and interests such as consumers’ right to know and the right to fair trade, and disrupts the stability and development of the market economic order, therefore, it is necessary to regulate the big data killing. Platform operators and consumers are the main parties to the transaction, the law is an effective means of social governance, and the government is an important subject of social governance. We should analyze the reasons for the frequent occurrence of big data from four aspects: law, consumers, platform operators and government supervision. The existing legal system is not complete, consumer rights protection is difficult, platform abuse of algorithm technology and imperfect regulatory system lead to the frequent occurrence of big data killing. Therefore, on this basis, it is proposed to improve the legal normative system, reduce the difficulty of consumer rights protection, strengthen industry self-discipline of platform operators, and build a complete regulatory system.
