%X 碳排放权交易是全球公认的一种具有实际效果的低成本减排新途径，需要对我国碳排放权交易法律制度的现状进行研究，探讨其需要完善之处并提出完善措施。我国碳排放权交易法律制度主要存在完善路径亟待明确、法律制度的框架和内容有待完善、相关配套制度需要健全三大问题。对此，文章提出了建立综合性立法体系、明确框架构建原则、明确关键性内容、提前构建碳金融交易配套法律制度等建议，旨在为我国碳排放权交易法律制度的发展提供思路。<br />
Carbon emission trading is a new way to reduce emissions with low cost and practical effect. It is necessary to study the current situation of the legal system of carbon emission trading in China, discuss its needs to be improved and put forward measures to improve it. There are three main problems in China’s carbon emission trading legal system: the path to improve needs to be clear, the framework and content of the legal system need to be improved, and the related supporting system needs to be improved. In this regard, this paper puts forward some suggestions, such as establishing a comprehensive legislative system, clarifying the framework construction principle, clarifying the key content, and establishing the supporting legal system of carbon financial trading in advance, in order to provide ideas for the development of China’s legal system of carbon emission trading.
