%X 近年来，市场规模持续扩张的有声读物，深陷版权保护困境，制约着有声市场的蓬勃发展。减少和防范有声读物版权风险，已经是当前有声读物产业发展的关键。本文通过对中国裁判文书网上有声读物版权纠纷案件的整理分析，发现在商业模式的运作背景下，有声读物存在法律关系复杂与授权不规范、网络服务平台未尽到较高的注意义务与间接侵权多发、侵权成本低与举证、维权难度大等一系列版权保护风险，因此在尝试对有声读物版权保护风险归因分析的基础上，寻求风险应对策略。为了形成对有声读物版权保护的善治格局，应当完善有声读物版权保护法规，增强全民版权保护意识，在寻找各方获益的共同基础上，规范授权合同的签署；同时强化传播平台的责任和义务，防范间接侵权风险，建构起全方位、系统化的有声读物版权保护闭环，促进有声读物市场繁荣发展。<br />
In recent years, the audio books whose market scale continues to expand are caught in the dilemma of copyright protection, which restricts the vigorous development of the audio market. Reducing and preventing the copyright risk of audio books has become the key to the development of audio books industry. Based on the analysis of copyright disputes over online audio books in China, this paper finds that under the background of business model, there are a series of copyright protection risks in audio books, such as complex legal relationship and irregular authorization, failure of online service platform to fulfill high duty of care, frequent indirect infringement, low cost of infringement and difficulty in proof and rights protection. Therefore, on the basis of trying to analyze the attribution of copyright protection risks in audio books, we seek countermeasures. In order to form a good governance pattern for copyright protection of audio books, we should improve the laws and regulations on copyright protection of audio books, enhance the awareness of copyright protection of the whole people, and standardize the signing of authorization contracts on the basis of finding common benefits for all parties; at the same time, strengthen the responsibility and obligation of the communication platform, prevent the risk of indirect infringement, construct an all-round and systematic closed loop of copyright protection for audio books, and promote the prosperity and development of the audio books market.
