%X ChatGPT的出现，促进了新媒体AI“洗稿时代”的来临。AI“洗稿”的成因主要包括三个方面：UGG模式的发展弊端、公众的知识产权意识淡薄、网络服务提供平台的监管不力和消极助长。对AI“洗稿”的规制，首先应当建立反洗稿义务共识，在此基础上统一全行业自律性规范并且建立全平台联合惩戒机制。具体路径包括三个方面：在立法保障方面，应当综合多方面进行法律保障，不仅仅限制在著作权法上。在行政保障方面，可以重视“声誉罚”的使用，并且增加平台的事前审查义务。在司法救济层面，主要采用公益诉讼和诉讼代理制度，以及将人工智能引入治理工具，提高治理效率并且发挥底层支撑和技术引领作用。<br />
The emergence of ChatGPT has promoted the advent of the “draft washing era” of new media AI. The causes of AI “draft washing” include three aspects: UGG model development drawbacks, the public’s weak awareness of intellectual property rights, network services to provide a platform for weak supervision and negative promotion. In order to regulate AI “draft washing”, we should first establish a consensus on the obligations of anti-draft laundering, on the basis of which we should unify the self-discipline norms of the whole industry and establish a joint punishment mechanism of the whole platform. The specific path includes three aspects: in the aspect of legislative protection, we should carry out comprehensive legal protection in many aspects, not only limited to the copyright law. In the aspect of administrative guarantee, we can attach importance to the use of “reputation penalty” and increase the platform’s obligation of prior review. At the level of judicial relief, it mainly adopts public interest litigation and litigation agency system, and introduces artificial intelligence into governance tools to improve governance efficiency and play the role of low-level support and technology leadership.
