%X 随着积极刑法观的倡导，轻罪在我国刑法罪名体系中有扩张趋势，因犯罪所产生的附随后果对犯罪人再社会化具有严厉的限制性，故在此背景下探讨我国犯罪记录附条件封存制度具有一定现实意义。本文从轻罪入刑的现实出发，具体探讨了犯罪记录所产生的附随后果、我国现有犯罪记录封存制度和域外相关制度与我国犯罪记录附条件封存制度的路径构建。<br />
With the advocation of positive criminal law concept, misdemeanors have an expansion trend in China’s criminal law crime system, and the collateral consequences of crimes have severe restrictions on the resocialization of offenders, so it is of certain practical significance to explore the conditional sealing system of criminal records in China in this context. Starting from the reality of criminalization for misdemeanors, this paper specifically discusses the collateral consequences of criminal records, the existing criminal record sealing system and extraterritorial related systems in China, and the path construction of China’s conditional sealing system for criminal records.
