%X 人工智能聊天机器人ChatGPT一经推出就引发广泛关注，其标志着人工智能已由弱人工智能向强人工智能过渡，作为一种自然语言生成模型，ChatGPT能够模拟人类对话，生成高质量的语言文本等，但其创作内容是否具有可版权性、是否应受到著作权法保护却是当下需要深思的问题。在我国现行《著作权法》暂未明确规制人工智能的有关问题的情况下，我们应当在现有的著作权法一般理论框架下分析ChatGPT生成内容是否可适用著作权法保护及其版权归属等问题，以应对相关领域存在的法律风险。<br />
Artificial intelligence chatbot ChatGPT has attracted widespread attention since its launch, marking the transition of artificial intelligence from weak artificial intelligence to strong artificial intelligence. As a natural language generation model, ChatGPT is able to simulate human conversations and generate high-quality language texts, etc., but whether its creative content is copyrightable and whether it should be protected by the copyright law is an issue that needs to be pondered at the moment. As the current Copyright Law of China has not yet clearly regulated the issues related to artificial intelligence, we should analyze whether the content generated by ChatGPT is protected by copyright law and whether the copyright belongs to it under the existing general theoretical framework of copyright law, in order to cope with the legal risks in the related fields.
