%X 在法律制度层面，我国尚未明确制定任何关于计算机单字的法律规范，关于计算机字库的保护制度也不健全，实践中计算机字体侵权案件又屡屡发生，严重影响了字库行业的发展。因此，为提高字库行业从业人员的积极性与创造性，推动字库行业的蓬勃向前，应尽快明确计算机字库及单字的法律地位，完善计算机字库及单字的知识产权保护。依据现行的法律规定，具有独创性的计算机字库和单字都是符合我国著作权法的作品。字库应当以计算机软件作品的形式进行保护，单字应当以美术作品的形式给予保护，字库及单字在受到著作权保护的同时也需要受到合理使用、默示许可、诚信原则的限制，只有这样才能真正促进司法公正和平等，从根本上减少相关纠纷案件的发生，从而为计算机字库产业发展塑造一个良好的社会氛围和市场环境。<br />
In the legal system, China has not yet clearly made any protection laws on single font, and the system for protecting computer font is also not sound. However, in practice, computer font infringement cases have repeatedly occurred which has seriously affected the development of China’s computer font industry. In order to improve the enthusiasm and creativity of workers in the computer font industry and promote the flourishing development of the computer font industry, we should clarify the legal status of computer font and single font as soon as possible and improve the intellectual property protection for computer font and single font. According to current legal regulations, creative computer word font and single font are works that comply with China’s copyright law. Computer fonts should be protected as computer software in copyright law, single font should be protected as work of art in copyright law, and those protections should be subject to the restrictions of the principle of fair use, the principle of implied license, and the Bona Fide Doctrine. Only in this way can we truly promote judicial fairness and equality, and fundamentally reduce the occurrence of related legal dispute, thereby shaping a good social atmosphere and market environment for the development of the computer font industry.
