Exploration of Improving China’s Civil and Commercial Mediation Mechanism in the Context of the Singapore Convention on Mediation %A 郭沛颖 %J Open Journal of Legal Science %P 4297-7305 %@ 2329-7379 %D 2023 %I Hans Publishing %R 10.12677/OJLS.2023.115610 %X 2019年,《新加坡调解公约》(以下简称《公约》)在新加坡正式签订并发布,该《公约》对现存的国际调解机制进行了填充,对国际经济的发展起到了至关重要的作用。同时也加快了我国民商事调解业务在新时代的发展步伐。基于《公约》给我国带来广泛而深远的积极影响,我国致力于《公约》的实施和推广。我国民商事调解存在基本法缺位、机构和人员专业性不足、调解模式主导性较强和和解协议执行难度大等问题,这些问题给我国很好地适用《公约》带来了挑战。我国可以尝试通过加强调解的相关立法、推动调解机构建设、提升调解员的专业素养和增强和解协议的执行机制等方式来更好地同《公约》接轨,为中国能够更好地参与全球治理和加强涉外法治建设提供坚实的法治保障。
In 2019, the Singapore Convention on Mediation (hereinafter referred to as the “Convention”) was officially signed and released in Singapore, which populates the existing international mediation mechanism and plays a crucial role in the development of the international economy. It has also accelerated the pace of development of civil and commercial mediation business in China in the new era. Based on the extensive and far-reaching positive impact of the “Convention” on China, China is committed to the implementation and promotion of the “Convention”. The absence of a basic law on civil and commercial mediation in China, the lack of professionalism of institutions and personnel, the dominance of the mediation model and the difficulty in enforcing settlement agreements have posed challenges to the good application of the “Convention” in China. China can try to better align itself with the “Convention” by strengthening the relevant legislation on mediation, promoting the construction of mediation institutions, upgrading the professionalism of mediators and enhancing the enforcement mechanism of settlement agreements, so as to provide a solid guarantee of the rule of law for the better participation of China in global governance and the strengthening of the rule of law in relation to foreign affairs. %K 《新加坡调解公约》,民商事调解,完善调解机制
