Implications of EU GDPR for China’s Participation in Global Regulation of Cross-Border Data Flows %A 严小群 %J Dispute Settlement %P 1611-1618 %@ 2379-3104 %D 2023 %I Hans Publishing %R 10.12677/DS.2023.94219 %X 数据跨境流动全球规制已是国际重要议题。中国争夺数据跨境流动全球规制话语权,完善国内法与国际法相协调是前提。我国国内立法与国际衔接上还存在安全评估严苛、监管制度不佳和国际合作不足等问题。欧盟《通用数据保护条例》(GDPR)的优势与劣势对于我国参与数据跨境流动全球规制具有重要价值。未来我国需要推动国内法与国际兼容,健全事前监管与事后问责机制,尊重他国主权和司法管辖权并积极合作参与数据跨境流动全球规制。
Global regulation of cross-border data flows has become an important international issue. In order for China to compete for the global regulation of data flow across borders, it is a prerequisite to improve the harmonization of domestic law and international law. China’s domestic legislation still has problems such as harsh security assessment, poor regulatory system and insufficient international cooperation. The strengths and weaknesses of the General Data Protection Regulation (GDPR) are of great value to China’s participation in global regulation of cross-border data flows. In the future, China needs to promote the compatibility between domestic law and international law, improve the mechanism of exante regulation and expost accountability, respect the sovereignty and jurisdiction of the first country and actively cooperate in the global regulation of crossborder data flow. %K 数据跨境流动,全球规制,GDPR
