%X 虚假诉讼罪在司法适用过程中面临诸多困境，民事上的虚假诉讼转化为虚假诉讼罪，中间需要一定的程序衔接，但在衔接过程中并无统一的程序规制，案件的移送标准不一致、案件管理流程不完善等问题阻碍了打击虚假诉讼的有效性。因此有必要在探究司法实践和现有理论争议的基础上，明晰虚假诉讼罪的两个保护法益之关系和实行行为的界定，以明确法院向侦查机关移送虚假诉讼案件的实体性审查标准、具体移送程序以及责任追究等问题，进一步推动和完善虚假诉讼罪的司法适用。<br />
The crime of false litigation faces many difficulties in the judicial application process. The conversion of civil false litigation into the crime of false litigation requires a certain procedural connection, but there is no unified procedural regulation in the process of connection, and the inconsistency in the criteria for the transfer of cases and the imperfection of the case management process have hindered the effectiveness of the fight against false litigation. On the basis of exploring judicial practice and existing theoretical disputes, this paper intends to clarify the relationship between the two protection law interests of the crime of false litigation and the definition of the implementation behavior, so as to clarify the substantive examination standards, specific transfer procedures and responsibility investigation of the court’s transfer of false litigation cases to the investigation organ, and further promote and improve the judicial application of the crime of false litigation.
