An Analysis of the Legal Attributes and Problems of the Birth Rights of Chinese Single Women—Taking Sichuan Province “Birth Registration Service Management Measures” as an Example %A 张玟韬 %J Advances in Social Sciences %P 3804-3811 %@ 2169-2564 %D 2023 %I Hans Publishing %R 10.12677/ASS.2023.127519 %X 今年四月关于独身女性是否拥有生育权和利用辅助生殖技术完成生育的话题登上微博热搜和热议话题,这是近几年来在“冻卵案”之后,该话题又一次为人所关注。该话题的成因在于我国生育权主体被限制于已婚双方,排除了独身女性。然而实际上,生育权在时间纵向和主体横向两个维度都展现了极高的价值属性,其价值位阶高于婚姻,不应当被后者限制。其次,从民法角度来看,生育权并非宪法性权力或身份权,而是人格权,说明生育权是自然人的一项基本权利,独身女性不应被排除在外。分析发现,造成这种将独身女性排除出生育权主体现象的原因在于社会对这类女性的歧视与偏见。因此,进一步破除性别歧视与偏见,落实平权政策,是进一步改善独身女性生育环境,促进我国人口平衡发展的关键一步。
The topic of whether single women should have reproductive rights and use assisted reproductive technology became a hot topic on Weibo in April this year, which was once again in the spotlight after the egg freezing case in recent years. The reason for this topic is that the subject of reproductive rights in China is limited to married couples, excluding single women. However, in fact, reproductive right shows the extremely high value attribute in both time vertical and subject horizontal dimensions. Its value is higher than marriage and should not be restricted by the latter. Secondly, from the perspective of civil law, reproductive rights are not constitutional rights or identity rights, but personality rights, indicating that reproductive rights are a basic right of natural persons, and single women should not be excluded. It is found that the reason for this phenomenon of excluding single women from the subject of reproductive rights lies in the social discrimination and prejudice against such women. Therefore, to further eliminate gender discrimination and prejudice and implement the affirmative action policy is a key step to further improve the birth environment of single women and promote the balanced development of our population. %K 生育权,人格权,女性,性别歧视
