%X 国家安全与经济全球化紧密联系、相互影响，当代安全政策为偏离普通贸易和投资规则提供了潜在的理由。关贸总协定中的“国家安全例外”条款赋予了国家在安全范围判断上极大的自由裁量权。实践中，国家安全内涵与外延的扩张对国际法庭善意履行原则审查、实质性与程序性审查均带来了挑战。面对该冲突，可以从实体法和程序法的角度探寻条款内部合法性，并从司法和非司法化角度寻求条款外部合法性，提出管理经济争端混合政治和法律的新兴战略，创新协调国家安全与经济全球化发展的新框架。<br />
National security and economic globalization are closely linked and interacted, and contemporary security policies provide potential justification for deviations from ordinary trade and investment rules. The “national security exception” clause in the GATT gives states great discretion in determining the scope of security. In practice, the expansion of the connotation and scope of national security has posed challenges to the review of the principle of good faith performance, substantive and procedural review by international tribunals. In the face of this conflict, the internal legitimacy of the clause can be explored from the perspectives of substantive and procedural law, and the external legitimacy of the clause can be sought from the perspectives of judicial and non-judicialization, proposing an emerging strategy for managing economic disputes with mixed politics and law, and innovating a new framework for reconciling national security with the development of economic globalization.
