%X 《中华人民共和国民法典》第933条规定了委托合同的任意解除权，无偿委托合同双方都享有任意解除权，在理论界和实务界都得到一致的认可。对于有偿委托合同中合同双方当事人，是否享有任意解除权呢？以及有偿委托合同的适用出现了很多的争议。在理论界和司法实践中就出现不同的观点，导致在司法实践的过程中也出现不同的判决。对于有偿委托合同任意解除权主要的争议点主要是有偿委托合同是否在所有的有偿委托合同中都享有任意解除权，在有偿委托合同中约定排除任意解除权效力的问题，以及有偿委托合同解除之后的损害赔偿的问题。<br />
Article 933 of the Civil Code of the People’s Republic of China provides for the right to rescind the commission contract at will. Both parties of the commission contract have the right to rescind freely, which has been unanimously recognized in both theoretical and practical circles. Do the parties to the contract en-joy the right of rescission at will? And there are a lot of disputes about the application of paid com-mission contract. In the theoretical circle and judicial practice, there are different views, which lead to different judgments in the course of judicial practice. The main disputes about the right of arbi-trary rescission of paid commission contracts are whether paid commission contracts have the right of arbitrary rescission in all paid commission contracts, the problem of excluding the effect of arbi-trary rescission in paid commission contracts, and the problem of damages after the rescission of paid commission contracts.
