%X “互联网+”时代区块链技术迅速发展并在证据领域逐步适用。通过对案例的实证分析发现区块链证据在民事诉讼司法审查认定过程中存在取证主体和取证流程合法性不足、区块链服务提供平台资质认定标准不统一、对区块链技术本身存在质疑以及对司法审查核验要素中清洁性的质疑等问题。建议对区块链证据认定路径、司法推定规则与鉴真规则进行完善，并尝试对区块链证据的合法性审查规则提出构想，以提升区块链证据在证据领域的适用率，使我国证据法体系在区块链证据的推动下迈向法治主义与技治主义互动的新型证据法治形态。<br />
The blockchain technology in the era of “Internet Plus” has rapidly developed and gradually applied in the field of evidence. Through empirical analysis of cases, it was found that blockchain evidence in the process of civil litigation judicial review and determination has issues such as insufficient legitimacy of the evidence collection subject and evidence collection process, inconsistent qualification standards for blockchain service providers, doubts about blockchain technology itself, and doubts about the cleanliness of judicial review and verification elements. It is recommended to improve the identification path, judicial presumption rules, and authentication rules of blockchain evidence, and attempt to propose ideas for the legality review rules of blockchain evidence, in order to improve the applicability of blockchain evidence in the field of evidence, and enable China's evidence law system to move towards a new form of evidence rule of law driven by the interaction between rule of law and technology.
