%X 在大数据时代背景下,科技在方便人们生活的同时也为偷窥公民隐私打开了一扇窗户,隐私权的传统法律保护模式迎来了新的挑战。现代社会,公、私双重权力主体对公民隐私权的侵犯不仅在技术上更容易,在事实上也颇为常见,而且隐私权的宪法价值没有受到足够的重视。因此,规范公权力以及私权力主体对公民隐私的侵犯行为,强化对公民隐私权的宪法保障,是我国建设现代化法治国家必须要面对的难题。本文通过探究公民隐私权的保护现状及其在宪法上的法理基础,以致力于在宪法层面上寻求大数据时代公民隐私权的规范保障与救济途径,完善公民隐私权的宪法保护。
In the context of the big data era, technology has opened a window for peeking into citizens’ privacy while facilitating people’s lives. The traditional legal protection model of privacy rights has faced new challenges. In modern society, the infringement of citizens’ right to privacy by dual power subjects, public and private, is not only technically easier, but also quite common in fact. Moreover, the constitutional value of the right to privacy has not received sufficient attention. Therefore, standardizing the violations of citizens’ privacy by public and private power entities, and strengthening the constitutional protection of citizens’ privacy rights are the challenges that China must face in building a modern country ruled by law. This article aims to explore the current situation of the protection of citizens’ privacy rights and their legal basis in the Constitution, with a view to seeking normative safeguards and remedies for citizens’ privacy rights in the era of big data at the constitutional level, and improving the constitutional protection of citizens’ privacy rights.
