%X 春秋决狱，有的学者把它称其为经义断狱，是指在具体司法实践中，通过引入春秋决狱等儒家思想的精神原则，作为确定量刑的基础，并以儒家思想为依据来解决政治、司法的问题。通过我们了解春秋决狱的社会历史的背景，对春秋决狱进行整理和归纳，进而深入研究原心定罪等一系列的司法审判的原则。深度挖掘春秋决狱思想的积极影响和消极影响，继承古代优秀法治思想，秉持司法公正，对当代立法、司法活动具有重要的借鉴意义，推动全面依法治国的建设。<br />
The Spring and Autumn Prison Sentence, which some scholars call the Jingyi Prison Break, refers to the introduction of the spiritual principles of Confucianism such as the Spring and Autumn Prison Sentence as the basis for determining sentencing in specific judicial practice, and using Confucianism as the basis to solve political and judicial problems. Through our understanding of the social and historical background of the Spring and Autumn Prison Sentence, we sort out and summarize the Spring and Autumn Prison Sentence, and then deeply study a series of judicial trial principles such as the conviction of the original intention. Deeply excavating the positive and negative influences of the Spring and Autumn Prison Sentences Thinking, inheriting the ancient excellent thinking on the rule of law, and upholding judicial justice, have important reference significance for con-temporary legislation and judicial activities, and promote the construction of comprehensive rule of law.
