%X 离婚冷静期制度是一种设置在原有的离婚程序上的前置程序，有助于避免或者减少情绪冲动引发的轻率离婚。离婚冷静期条款中存在缺乏对离婚冷静期例外情形的规定、对夫妻权利义务关系规定不明确等问题。域外设置离婚冷静期的例外情形、区分离婚冷静期的非常规化情形值得我国借鉴。我国离婚冷静期条款中应增加离婚冷静期的例外规定、明确离婚冷静期内夫妻权利义务关系。<br />
The divorce calm period system is a pre-procedure set on the original divorce procedure, which helps to avoid or reduce the reckless divorce caused by emotional impulse. There are some problems in the provisions of the cooling-off period of divorce, such as the lack of provisions on exceptions to the cooling-off period of divorce, and the unclear provisions on the relationship between the rights and obligations of the couple. The exceptions to the setting of the cooling-off period of divorce and the unconventional circumstances to distinguish the cooling-off period of divorce outside the country are worthy of our reference. China should add the exception of the cooling-off period of di-vorce to the cooling-off period of divorce, and clarify the rights and obligations of the couple during the cooling-off period of divorce.
