%X 离婚冷静期引发了对离婚自由的争议，而婚姻伦理也正遭受着极端自由主义和个人主义的冲击。从法哲学的视角来看，离婚冷静期制度有着存在的合理性，因为任性的自由并非自由，“人性恶”假设和人性的弱点也佐证了应当对离婚自由进行适度限制。此外，离婚冷静期制度有着其固有的制度价值，既伦理价值与秩序价值。<br />
The divorce cooling-off period has aroused the controversy over the freedom of divorce, and the marriage ethics is also under the impact of extreme liberalism and individualism. From the perspective of legal philosophy, the existence of the divorce cooling-off period system is reasonable, because capricious freedom is not freedom, the “evil human nature” hypothesis and the weakness of human nature also prove that the freedom of divorce should be moderately restricted. In addition, the divorce cooling-off period system has its inherent institutional value, both ethical value and order value.
