%X 宪法作为根本大法以其绝对权威性统领一国规范系统,全方位指导着国家机关的运行和人的现实生活。在法哲学层面上,人作为宪法哲学的一个元点,既是其起点也是其归宿。宪法哲学的基本矛盾是国家权力和公民权利之间的矛盾,“以人为本”寓于宪法哲学基本矛盾的对立统一之中。本文以“以人为本”为切入点分析宪法哲学的内在逻辑,探讨人、政府和宪法的共同发展。
As the fundamental law, the Constitution commands a country’s normative system with its absolute authority, and guides the operation of state organs and the real life of people in an all-round way. On the level of legal philosophy, human, as a meta point of constitutional philosophy, is both its starting point and its destination. The basic contradiction of constitutional philosophy is the contradiction between state power and civil rights. “People-oriented” lies in the unity of opposites of the basic contradiction of constitutional philosophy. This paper analyzes the internal logic of constitutional philosophy from the perspective of “people-oriented”, and discusses the common development of people, government and constitution.
