%X “恶法亦法”或“恶法非法”,无论是在哲学范围内还是法学范围内都是一个永恒讨论的话题。本文围绕“苏格拉底之死”展开,分析了“恶法亦法”的内在逻辑和价值理念。囿于人类立法智慧的有限性,“恶法”的存在是难免的,其背后是法的价值与正义的冲突。本文认为,从现实意义来讲,只要是正当制定的法,就应该被遵守被执行,应最大限度地维护法的安定性与权威性,即使这种法律会损害一定的个人利益;此外,在法治的现代化进程中,要正视“恶法”的真正价值,推进法治国家的建设。
“Evil law is also law” or “evil law is illegal” is a topic of eternal discussion, both in the philosophical and legal context. This article focuses on the “death of Socrates” and analyzes the internal logic and value concept of “evil law and law”. Limited by the limited wisdom of human legislation, the existence of “evil law” is inevitable, and behind it is the conflict between the value of law and justice. This article argues that in a practical sense, as long as it is a properly enacted law, it should be observed and enforced, and the stability and authority of the law should be maintained to the greatest extent, even if such a law will harm certain personal interests; In addition, in the process of modernizing the rule of law, it is necessary to face up to the true value of “evil law” and promote the construction of a country ruled by law.
