Legislative Regulation of Property Disputes of Non-Marrital Cohabitation %A 陈文杰 %J Dispute Settlement %P 761-769 %@ 2379-3104 %D 2022 %I Hans Publishing %R 10.12677/DS.2022.84103 %X 随着经济社会的发展和生活思想观念的转变,婚姻已不是唯一的家庭生活模式,非婚同居现象逐渐增加,现行法律存在的问题是对由非婚同居纠纷中最为突出的财产纠纷规定的缺位,目前仅有数量较少且零散的司法解释。笔者认为构建非婚同居的财产法律制度,首先应明确非婚同居及非婚同居财产的概念、特征,然后通过对比分析国外非婚同居的财产法律规制与我国的立法现状,总结出适合我国学习借鉴的方面。对我国非婚同居财产纠纷的法律规制,应在确定立法原则的基础上,以时间为线索对非婚同居前、中、后面临的财产法律问题进行针对性的设计解决。同时要结合我国当前对非婚同居已有的司法解释,以此得出一套以非婚同居的财产分配、债权债务承担、遗产与继承、赠与、损害赔偿、经济帮助请求权以及对待老年人的非婚同居财产关系的特殊处理为内容的制度体系。
With the development of economy and society and the change of life concept, marriage is not the only mode of family life. The phenomenon of non-marital cohabitation is increasing day by day. The most noticeable social problems caused by non-marital cohabitation are property disputes, but the number of provisions on this is relatively small and scattered in the current law. The author believes that the concept and characteristics of non-marital cohabitation and property should be clarified at first, when we want to construct the property legal system of non-marital cohabitation. By comparing and analyzing the foreign property legal regulation of non-marital cohabitation and domestic legislative situation, the author summarizes the aspects suitable for China to learn from. The specific idea of China’s non-marital cohabitation property system should be based on the legis-lative principle, and take time as a clue to devise the non-marital cohabitation property legal sys-tem. At the same time, we should consider current judicial interpretation of unmarried cohabita-tion in our country. Thus we can construct a system with the allocation of unmarried cohabitation property, creditor’s rights and debts, the inheritance, gift, damage compensation, claim to economic help and special groups of the elderly of unmarried cohabitation property relationship. %K 非婚同居,财产关系,婚姻家庭
