On the Protection of Consumers’ Rights and Interests under the Big Data “Discrimination” %A 肖攀 %J Advances in Social Sciences %P 4344-4349 %@ 2169-2564 %D 2022 %I Hans Publishing %R 10.12677/ASS.2022.1110593 %X 随着大数据技术的发展,近年来一些不良商家利用大数据技术和法律漏洞实施了大数据“杀熟”行为。为了保护消费者不被大数据“杀熟”和保障其权利救济的实现,本文首先在引言部分分析了大数据的含义与实现途径,接着从消费者权益保护的角度出发论证了大数据“杀熟”行为严重损害了消费者的知情权、公平交易权和个人信息权,进而从立法、市场监管、权利救济等层面相应提出保护消费者权益的建议。
With the development of big data technology, in recent years, some unscrupulous businesses have taken advantage of big data technology and legal loopholes to “kill” big data. In order to protect consumers from being killed by big data and ensure the realization of their rights relief, this paper first analyzes the ways to realize big data, and demonstrates that the killing behavior of big data seriously damages consumers’ right to know, fair trade and personal information from the perspective of consumer rights protection. Then, in the level of prevention in advance, the law should properly extend consumers’ right to know, improve the regulation of algorithm rights by law and enhance consumers’ awareness of rights protection. After the “killing” behavior of big data has occurred, that is, at the level of supervision in the event, this paper puts forward suggestions to improve the market supervision system; on the level of relief after the event, this paper puts forward some suggestions to strengthen the relief of consumers’ rights. %K 大数据“杀熟”,消费者权益,保护
