%X 新时代背景下，党中央提出要坚持绿水青山就是金山银山的理念，坚定不移走生态优先、绿色发展之路，而法治手段是保护生态环境、有效化解经济发展与生态环境矛盾、促进绿色发展的必然选择。在对陕西秦岭山区绿色发展法律保障现状进行梳理的基础上，分析在法律保障方面存在立法缺乏相关立法、理念不够深入、立法缺乏系统性规划性协调性、地方立法发挥不够、社会主体参与度不够等困境，从完善立法、贯彻理念、加强协同、执行实施持久之功、完善保障性措施等方面提出完善措施，为陕西秦岭山区绿色发展的法律保障提供理论参考。<br />
Under the background of the new era, the Central Committee of the Communist Party of China (CPC) proposed to adhere to the concept that green mountains are gold and silver mountains, unswervingly take the road of ecological priority and green development, and legal means is the inevitable choice to protect the ecological environment, effectively resolve the contradiction between economic development and ecological environment, and promote green development. On the basis of sorting out the current situation of legal guarantee for green development in Qinling Mountain area of Shaanxi Province, it analyzes the difficulties in legal guarantee, such as lack of relevant legislation, lack of indepth ideas, lack of systematic planning and coordination of legislation, lack of local legislation, and lack of participation of social subjects. In order to provide theoretical reference for the legal protection of green development in Qinling mountain area of Shaanxi province, some measures are put forward from the aspects of perfecting legislation, carrying out ideas, strengthening coordination, implementing lasting achievements and improving guarantee measures.
