The Legal Dilemma of “Death from Overwork” under the Framework of Labor Law and Its Solution %A 李桂君 %J Open Journal of Legal Science %P 834-841 %@ 2329-7379 %D 2022 %I Hans Publishing %R 10.12677/OJLS.2022.105107 %X 近几年,媒体上经常出现过度劳动甚至“过劳死”的悲剧,引起了社会的极大关注和热烈的讨论。但是,目前我国“过劳死”的严重状况尚未得到应有的重视,现有立法难以对其进行有效的法律规范。本文通过对近五年有关“过劳死”的案例进行实证分析,厘清现阶段我国“过劳死”问题的法律规制困境,从事前预防和事后救济两方面提出建议,完善劳动者加班制度,加强对用人单位违法加班的处罚力度,立法上将“过劳死”纳入工伤保护的范围,确立“过劳死”的工伤认定标准。
In recent years, there have often been tragedies of overwork or even “overwork and death” in the media, which has aroused great concern and heated discussion in society. However, at present, the serious situation of “death by overwork” in China has not received due attention, and it is difficult for existing legislation to effectively regulate it. Through the empirical analysis of the cases of “overwork death” in the past five years, this paper clarifies the legal regulatory dilemma of the problem of “overwork death” in China at this stage, makes suggestions in both pre-prevention and post-relief, improves the overtime system for employees, strengthens the punishment for illegal overtime work of employers, and legislatively includes “overwork death” in the scope of work injury protection, and establishes the work injury identification standard of “overwork death”. %K 过劳死,劳动保障监察,“双工 + 48小时”,工伤认定
