%X 非法提供麻醉、精神药品罪在刑法中列于走私、贩卖、运输、制造毒品章节内的最后一项罪名，也是非常独特的一项罪名。我国《刑法》在对该项罪名的条文中进行了法律拟制，即对非法提供麻醉、精神药品罪转化为贩卖毒品罪进行了罪状描述。本文拟就该转化型犯罪中以牟利为目的，向吸毒人员提供麻醉、精神药品的主、客观构成要件的若干问题，逐一梳理、辨析。<br />
The crime of illegal supply of narcotic and psychotropic substances is the last crime listed in the chapter of smuggling, trafficking, transportation, and manufacturing of drugs in the Criminal Law, and it is also a very unique crime. China’s Criminal Law provides a legal formulation of this crime, i.e., the crime of illegal provision of narcotic and psychotropic drugs is transformed into the crime of drug trafficking. This article intends to sort out and analyze several issues regarding the subjective and objective elements of the crime of providing narcotic and psychotropic drugs to drug addicts for profit.
