%X The private enforcement of competition law has potential to play an important role in achieving undistorted competitive markets. Regarding this, the Act No. 4054 on the Protection of Competition article 58 allows victims of unlawful acts of undertakings that infringe the competition norms to bring damages actions cases before the courts. According to article 58, it is possible to request treble damages via private litigation. Due to the fact that this right is not in line with the philosophy behind Turkish liability law system, the purpose of this study is to detect the features of this norm and to bring solutions to current problems caused
