%T VALUES TO BE ADDED IN THE REGIME OF PARTICIPATION IN ACQUIRED PROPERTY

%X The issue of values to be added in the regime of participation in acquired property is an important factor in the calculation of surplus value. In this regime, claim of participation is calculated on the half of the surplus value of the other spouse. In the calculation of surplus value, not only the acquired property at the end of the property regime, but also in addition to the equalisation, the values specified on article 229/I of Turkish Civil Code are taken into consideration. Thus, the legislator ensures that the acquired property is added as an account of the value of transactions foreseen in the relevant provision. Under favour of the institution of adding, the claim of participation of the spouse who didn¡¯t make the transaction, is protected. In this respect, the values to be added as an important institution in the division of matrimonial property shall be examined in this study. Firstly, information will be given about the transactions mentioned in the article 229/I. Then, the proposal of the addition request and the burden of proof will be examined. Thirdly, the realization of the adding and its legal consequences will be emphasized. Finally, propounding of the addition request against third parties, will be evaluated together with article 241
