%0 Journal Article %T Violence against Women: According to £¿stanbul Islamic Jurisprudence Records %A £¿nder £¿lgili %J - %D 2019 %X Object: ¡°Islamic Jurisprudence Records¡± one of the important sources for Turkish History reflecting political, social and economic aspects of Ottoman Society form XVth century until the end of XIXth century. These records can be regarded as valuable sources for history of law and medicine due to their extensive content. Materials and Methods: ¡°Violence¡± and in particular ¡°violence against women¡± became an important issue regarding medical practice and our social life in recent (past) ten years. This study is conducted to evaluate the historical aspects of ¡°violence against women¡±, over occasions covered by £¿stanbul Islamic Jurisprudence Records. £¿stanbul Islamic Jurisprudence Records (1-40) published by Turkish Divinity Foundation Center for Islamic Studies were enjoyed. The books enjoyed were including in sum 23387 records. Records concerning violence against women, regardless to the gender of the perpetrator, determined and classified. Classification was conducted according to the titles and subtitles in the classification of the crimes in Ottoman Criminal Law. Results: Results includes physical violence cases as ¡°battery¡±, ¡°torture¡±, ¡°virginity testing¡±, ¡°commercialization of female body¡±, ¡°indecent assault¡±, ¡°rape¡± and ¡°homicide¡±, as well as verbal violence cases concerning ¡°insulting¡± and ¡°aspersion¡±. People of both sexes (both men and women) were determined as perpetrators of these acts. Also both total strangers and intimate people were involved as perpetrators in these occasions concerning aggressive behavior. Conclusions: During XVIth and XVIIth centuries in £¿stanbul, victims of violence against women were used their rights given in positive jurisprudence system and applied to courts, in search of safety and protection form prosecutors, personally or by their representative.
