%T Evaluation of Some Verses and Had¨©ths Which Have Legitimized Violence against Women and Used As Evidence

%X Violence against women takes places at the top of the problems faced by our country, as it is in other countries. In a society which pride itself as a Muslim, some male adherents of Isl¨¡m, which is a religion of love, peace and compassion, apply violence in their wives and women whereas they have been created for friendship, love and compassion by depending on misinterpreted verses, hadiths, tradition and ignorance. This is one of the most painful aspects of the problem. Therefore, the main purpose of this study is to explain the question of nush¨±z (disloyalty, ill-conduct, rebellion) and of beating, in the 34th verse of the Nis¨¡ surah (4:34) which is shown as evidence that it gives a right for husbands to beat their wives in some circumstances and to evaluate the other hadiths which were mentioned in Sah¨©h al-Bukh¨¡r¨© in Chapter Marriage (Nik¨¡h 93). In this context, It will be emphasized that how does the husband behave against his n¨¡shiza wife, which methods should he follow, in order to give up her nush¨±z and it is not possible to accurately interpret without fully determining the meaning of the key words ¡°nush¨±z¡± and ¡°idrib¨±hunna¡± used in verses. The basic approach of the Qur¡¯¨¡n and the Sunnah will be examined in the light of verses and related had¨©ths, and it will be discussed and evaluated with a broad view, whether it is possible to interpret some of the hadiths referring to the beating of woman. As a method, neither a completely classical approach nor a preconceived notion nor a modern and feminist point of view will be adopted, but instead, it will be focused on how did first Muslim scholars and contemporary researchers interpret the related verses and hadiths, and then evaluate their the contexts of related hadiths and paying attention the contexts and occasions of the Revelation of the Qur¡¯¨¡n (asb¨¡b al-nuz¨±l), finally the issue will be tried to be assessed from a holistic and a broad perspective. Even though men can also commit nush¨±z, in this paper, it will be analyzed just female nush¨±z towards their husbands
