%0 Journal Article %T The Comparison of Enforcement as a Regulative Process During the State of Emergency with Presidential Decrees and State of Emergency Decrees %A Mehmet BOZTEPE %J - %D 2018 %X The principles of passing to the ¡°Presidential government model¡± from the classical parliamentary system with the Law No:6771 on the Amendment of the Constitution of Republic of Turkey which has held a referendum on a constitutional amendment on April 16, 2017 have been formed. Decree Laws regulated by Article 91 of 1982 Constitution have been abolished with the constitutional amendment. In this context, ¡°the Presidential Decree¡± was introduced as a new regulatory process for the executive instead of the decree laws issued during the state of emergency. The presidential decrees which are not in the power of Law during the ordinary period have been determined as norms during the state of emergency and were excluded from the Constitutional Court audits parallel to the Decree Laws of the state of emergency.
