%X 中药经典名方是中医药传统知识的重要组成部分，是不可或缺的知识产权形式。然而现代专利制度 下中药经典名方存在诸如申请量少授权率低、研发创新不足、专利权流失、侵权认定困难等问题。针对这些问 题，并结合中药自身特点，笔者提出构建经典名方创新研发体系、健全经典名方专利管理体系、促进中医药专利 国际化认证、进攻性与防御性策略相结合等建议。<br>The classical prescriptions of traditional Chinese medicine (TCM) are an important part of TCM knowledge and an indispensable form of intellectual property. However, under the modern patent system, classical TCM prescriptions have problems such as low application and authorization rates, less research & development (R&D) innovation, loss of patent rights, and difficulty in identifying infringement. In response to these problems and considering the characteristics of TCM, we propose to build a classic innovative R&D system, to establish the patent management system of classical prescriptions, to promote the internationalization of Chinese medicine patents, and to combine aggressive and defensive strategies
