%X 中医药是中华民族原创的医学科学，是中华文明的杰出代表，数千年来为中华民族的繁衍昌盛做出 了重要贡献。文章从地方中医药条例的立法背景出发，介绍了地方中医药条例的立法历程，并从中医药特色、各 部门职责、中药保护内容、中医药保障措施等方面分析了地方中医药条例的立法困境，提出地方中医药条例的制 修订应以《中华人民共和国中医药法》为纲，立足中医药发展实际，明确各部门分工职责，加强中药保护与发 展，建立健全政策保障体系等措施。<br>Traditional Chinese medicine is the original medical science of the Chinese nation. It is an outstanding representative of the Chinese civilization and has made important contributions to the prosperity of the Chinese nation for thousands of years. Based on the legislative background of local Chinese medicine regulations, the article introduces the legislative process of local Chinese medicine regulations, and analyzes the legislative dilemma of local Chinese medicine regulations in the aspects of characteristics of Chinese medicine, duties of various departments, contents of Chinese medicine protection, and measures for the protection of Chinese medicine. It is proposed that the revision of local Chinese medicine regulations should be based on the Law of the People’s Republic of China on Traditional Chinese Medicine, based on the actual development of Chinese medicine, clarify the division of responsibilities of various departments, strengthen the protection and development of Chinese medicine, and establish and improve measures such as the policy guarantee system
