%X 国际投资法体系经历了从外部均衡到内部均衡的演化历程,均衡自由主义已经成为一种趋势,但是投资者权利和东道国监管权的最佳平衡点可能因国、因时、因人而变。投资者―国家争端解决(ISDS)机制以商事仲裁为本,公法控制机制缺位,总体上对资本输出、治理水平较高、法律队伍发达的国家有利。中国是一个治理水平相对较高、法律队伍不够发达的资本输出国,并且是投资双向流动大国、具有高风险投资结构、处于高风险投资时期,应坚持均衡自由主义进路,维护并完善ISDS机制,推动其朝着有利于中国利益与国际公益的方向演进。中国应考虑在投资者诉权、仲裁员任命权、仲裁裁决执行等方面坚持传统ISDS机制,并以多边程序改革为契机,完善ISDS机制的公法化制度设计。
China should adopt a balanced liberalism approach to support and improve the investor-state dispute resolution(ISDS). International investment law regime has evolved from a regime of external balance to one of internal balance, increasingly dominated by a balanced liberalist approach. However the optimal balance between the right of foreign investor and the regulatory power of host state is sensitive to the states, times and stakeholders. The classical ISDS is blueprinted on commercial arbitration and normally unchecked by public law accountability mechanism. And the ISDS is more beneficial to states with more outward investment, good domestic governance and developed legal service industry. Given China’s large inward and outward investment flow, risky investment destination and structure and strong domestic governance with relative weak legal industry, she should maintain the essential function of ISDS and promote its improvement to better suit China’s interest whilst serving the general interest of the international community. China should thus seek to keep the procedural rights of investor to initiate the proceedings, to appoint the members of tribunal, to enforce the judgment of ISDS as arbitral awards, and supplement the classical ISDS with enhanced public law mechanisms at multilateral reform discussions
