%X 我国保健食品产业发展迅速，但法律法规对保健食品的定义、功能及作用的界定存在着值得深入探 究的问题，如保健食品的定义、功能界定，中国传统保健食品的定义、功能界定，保健食品在疾病辅助治疗与疾 病预防中的作用，等等。针对这些问题笔者从法律层面、民间习惯与习俗、中国传统保健食品的特点等方面进行 了探究，希望起到正本清源的作用，促进我国保健食品市场的健康发展，使中国传统保健食品得到发扬光大。<br>The dietary supplement industry in China is developing rapidly. However, there are some issues that need to be further studied in related laws and regulations, including the definition of dietary supplement and its function definition, the definition of Chinese traditional dietary supplement, what roles dietary supplement plays in disease adjuvant therapy and disease prevention, etc. From the perspective of law, folk habits and customs, and the characteristics of traditional Chinese dietary supplement, the author tried to explore the accurate definition and role description of dietary supplement in the hope of promoting the healthy development of the dietary supplement market, in particular, developing China’s traditional dietary supplement
