%X 随着我国农业现代化的纵深推进,在大力发展乡镇企业经济推动农业工业化的同时,爆发式的乡镇企业增长、规模化的农业生产经营以及聚集型的农村生活场域的出现等,造成了农村环境污染的日益恶化,农村环境纠纷也随之频发,并显现出与城市环境纠纷不同的特点。现行的以诉讼为主的纠纷解决机制在解决农村环境纠纷上较为乏力。为此,有必要通过构建新的非诉讼机制——环境ADR解决农村环境纠纷,以维护广大农村地区社会关系的和谐稳定,切实保障农村底层居民的环境权益的实现。<br>With the development of China’s agricultural modernization, vigorously developing the economy of township enterprises can promote agricultural industrialization, while the explosive growth of township enterprises, the large scale agricultural operation, the emergence of the aggregation type field of rural life and so on caused deteriorating of environmental pollution in rural areas, and the rural environmental disputes frequently occur which are different from the urban environmental disputes. The current procedure oriented dispute resolutions which mainly rely on the civil litigation to solve environmental disputes in rural areas are not effective. Therefore, it is necessary to construct a new mechanism, ADR for environmental disputes to solve the rural environmental disputes, so as to maintain the harmony and stability of rural social relations and protect effectively the environmental rights and interests of the rural dwellers.
