%T 我国农地土壤污染防治立法探析<br>Discussion on Legislation of Soil Pollution Prevention and Control in China

%X 当前农地土壤污染已经成为最严重的环境问题之一，严重制约了农业现代化的进程。法律手段是解决农地土壤污染问题的核心，但我国现行农地土壤污染防治立法明显存在不足，严重制约了其功能的有效发挥。完善农地土壤污染防治立法，需要制定一部统一的农地土壤污染防治综合性法律，修改现行法律的相关内容；补充农地土壤污染防治方面的立法空白；强化农地土壤环境管理机构的强制性手段，协调相关的利益关系；严格法律责任；改革农地土壤环境执法体制，从而为做好农地土壤污染防治工作提供有力的法律保障。<br>Farmland soil pollution has become one of the most serious environmental problems at present, which seriously restricts the process of agricultural modernization. Law is the key to resolve the problem of farmland soil pollution, but law of farmland soil pollution prevention and control in China is not very perfect, which seriously restricted its function. In order to perfect farmland soil pollution prevention and control legislation, we should constitute an unified land soil pollution prevention and control law, modify current law’s related content; fill gaps in legislation; strengthen enforcement mandatory means of farmland soil environmental agencies, coordinating the interests relations; strict legal responsibility; and reform farmland environmental legal enforcement system.
