%0 Journal Article %T 集体建设用地使用权流转的政策改革与立法突破<br>Study on Legislative Improvement of Use Right’s Circulation of Collective Construction Land in China %A 唐欣瑜 %J 西北农林科技大学学报(社会科学版) %D 2015 %X 尽管集体建设用地使用权的有偿流转在我国现行法律框架内深受限制,但各地开展的试点实践与地方立法对现行法律已有很大突破。自十八届三中全会以来,农村集体建设用地进入市场流转已得到中央政策的确认,相关立法也有必要随之完善,并具备了完善的可行性基础。应从明确集体建设用地使用权的用益物权属性、修改《土地管理法》相关规定、制定全国性专项法规三个方面对集体建设用地使用权流转进行立法突破。<br>Although China’s existing law always take a cautious attitude towards the marketizational circulation of collective construction land use right, the pilot practice and local legislation of some areas have been a great breakthrough to the existing laws. The Third Plenum of the 18th CPC Central Committee put forward that the collective construction land can circulate in the market. It’s necessary and feasible to improve relevant legislations about the circulation of collective construction land use right.
