%0 Journal Article %T 高等教育第三方评估机构的法律身份及其适用逻辑<br>Legal Identity and its Application of the Third Party Evaluation Institutions in Higher Education %A 黄明东 %A 陶夏 %J 大学教育科学 %D 2018 %X 随着教育管理向教育治理理念的转变,高等教育评估 模式的创新越来越强调第三方评估机构的作用。而如何落实 高等教育第三方评估机构的法律身份,规范其经营并有序地开 展评估和质量监测的专业服务,已成为当前推进高等教育领域 “放管服”改革的热点与难点之一。通过简要考察在高等教育 评估方面比较成熟的一些国家的高等教育第三方评估机构的 法律身份及其运作过程,可以为我国高等教育第三方评估机制 的构建提供有益参照。在我国,作为连接政府与高校、高校与 社会的双重中介身份,高等教育第三方评估机构在法律运行过 程中形成了既有行政法律关系又有民事法律关系的双重法律 关系。因此,我们有必要从法律规范、法律关系和法律责任这 三方面入手,对我国高等教育第三方评估机构法律身份及其适 用逻辑进行深入探讨。<br>With the conceptual shift from educational management to educational governance, the assessment of higher education has been innovated, which has increasingly emphasized the role of third-party evaluation institutions. How to implement the legal identities of third-party evaluation institution of higher education, standardize their operations, and carry out professional services for evaluation and quality monitoring in an orderly manner has become one of the hotspot and difficulty in promoting the reform of “distribution, management and service” in the field of higher education. By examining the legal status and operation process of third-party evaluation institution of higher education in some mature countries briefly, it can provide a useful reference for the establishment of thirdparty evaluation mechanisms for higher education in China. In our country, functioning as bridges that connect the government and universities, as well as the society and universities, third-party evaluation institution of higher education has formed a dual legal relationship with both administrative and civil legal relations during the legal operation.
